Divorce St. Charles, MO 11th Circuit Case Results

In 2014, a client came to us very unhappy with the attorney she had been using. The client had incurred over $30,000 in attorney fees since the start of her St. Charles County case in 2012. Upon entering on the case, we began to thoroughly prepare for trial but started something that had not taken place up to that point: negotiating. Within several months of negotiating with the opposing counsel, the parties were pleased to settle outside of court, and in turn, saved several thousand dollars. Our Divorce Attorneys were able to help out our client quickly and professionally.

Frequently Asked Questions About Missouri Divorces

At Boehmer Law, we are committed to helping our clients find the answers to all their divorce questions. Here are some we hear most often:

What are the grounds for divorce in St. Charles, Missouri?

Missouri Revisor Statute 452.320 lists adultery, intolerable behavior, separations for 12 months if your spouse agrees to the divorce, separation for 24 months if your spouse does not agree to the divorce and abandonment for six months or more. However, the vast majority of divorces are accomplished through a “no-fault” process based on the idea that the marriage is irretrievably broken.

How do I start the divorce process in Missouri?

To initiate divorce proceedings, at least one spouse must have lived in Missouri for 90 days or longer and a Petition for Dissolution of Marriage must be filed with the local circuit court. The respondent spouse must then be served with the appropriate papers, after which they have 30 days to respond.

What is the difference between a contested and uncontested divorce in St. Charles, Missouri?

An uncontested divorce is one where both spouses agree on all the issues, including the division of assets and debts, spousal support and child custody. Contested divorces are those in which the spouses cannot agree on one or more issues, and the case goes to litigation. Uncontested divorces are typically more amicable, faster and less costly.

How long does the divorce process take in Missouri?

An uncontested divorce can take as little as one or two months (a 30-day waiting period is mandatory). A contested divorce can take six months to a year, if not longer.

How can a lawyer help me with my divorce in St. Charles, Missouri?

An experienced divorce attorney can ensure that all the documents are properly completed and the technical steps are followed. Your attorney can also make sure that your interests are protected during asset and debt division, alimony negotiations, business valuations, custody decisions and more. If the divorce becomes contested, an attorney can present your case to the court in the best possible light.
